1. Scope

4. Right of withdrawal for consumers

4.1 Consumers have a right of withdrawal in accordance with the instructions below. The right of revocation does not exist if the data carriers (compact discs, records) delivered in a sealed state have been unsealed by the consumer. When purchasing digital content (downloads), the consumer loses his right of withdrawal if he expressly agrees that we will start executing the contract before the withdrawal period has expired and that he has confirmed his knowledge of this connection.

5. Prices and shipping costs

6. Delivery

6.1 Delivery takes place within 1 to 3 working days by German Post, DHL or Hermes.

8. Retention of title

The goods remain the property of Klangschutz Schallplatten until full payment has been made.

9. Liability

With regard to all claims for damages or reimbursement of wasted expenses, the seller is not liable for simple negligence, provided that the seller has not breached an essential contractual obligation and there is no injury to life, body or health. In the event of a breach of an essential contractual obligation due to simple negligence, the seller's liability is limited to the typical contractual damage that was foreseeable at the time the contract was concluded, unless life, body or health were impaired. Liability under the Product Liability Act or other implementations of Directive 85/374 / EEC remains unaffected. The personal liability of the legal representatives and employees of the seller is also limited to the aforementioned extent.

10. Choice of law

The law of the Federal Republic of Germany, including the provisions of the UN sales law, is exclusively applicable to this contract. If the customer is a consumer and has his habitual residence outside of Germany, the mandatory consumer protection regulations of the country in which the customer has his habitual residence remain applicable in accordance with Art. 6 Paragraph 2 of Regulation (EC) No. 593/2008.

11. Place of jurisdiction

For all legal disputes in connection with the contract concluded between the parties or its validity, the courts in Munich responsible for the registered office of the seller are exclusively responsible if the customer has his residence or registered office in Germany and a businessman, a legal person under public law or a special fund under public law. The aforementioned exclusive jurisdiction is also given if the customer is an entrepreneur and has his seat or residence outside of Germany.

12. Ineffectiveness of individual clauses

Should any provision of these terms and conditions be or become ineffective, this shall not affect the effectiveness of the remaining provisions.
